Three women, Angela Fletcher, 54, Bernice Lowe, 57, and Rosemary Mangum, 76, have filed a lawsuit in Manhattan Supreme Court against Loehmann’s alleging that the clothing company discriminated against the three women based on their age. According to the New York Post, “they were axed because they don’t fit the youthful image the struggling discount store is aiming for.”
In their lawsuits, the women allege that the company found excuses to fire them from their jobs at Loehmann’s. The company’s reason for letting Fletcher go was because she allegedly worked overtime. They let Lowe go because another co-worker made bogus allegations against her. Finally, Mangum was let go without warning because she apparently gave too many discounts.
However, the three women believe they were fired because of age discrimination, and have filed a lawsuit against Loehmann’s in that regard.
What Is Age Discrimination?
According to the United States Congress, age discrimination involves treating an employee less favorably than others because of his or her age. For example, it would be a crime to discriminate against a person because of his or her age with respect to any aspect of employment, including hiring, firing, promotion, and laying off. When one is terminated from their job without legal grounds, they are said to be wrongfully terminated. If a wrongfully terminated employee prevails in their lawsuit, the fired employee is entitled to punitive damages and lost wages.
