The following story is every girl’s worst nightmare.  A 20-year-old girl from Australia visiting New York was raped after leaving a high profile New York nightclub.  According to numerous reports, she left New York’s Lavo nightclub around 3:30am, got into a cab where she ended up arguing with a cab driver, got out of the cab and was thereafter dragged into an alley where she was brutally raped.  Although the victim was too intoxicated to remember the exact location of the attack, she is certain that it occurred near the Lavo nightclub.

According to the NYPost, there are no suspects in custody.  However, the victim described the suspect “as a black male, 35-40 years old, about 190 pounds, and a height of about about 6-foot-2.”

What is Rape?

Rape is a sex crime that involves the "unlawful carnal knowledge of a woman by a man, not her husband, without consent."  The slightest penetration completes the crime.  Moreover, a lack of consent by the victim can be enough to convict the perpetrator of rape.  Some factors that help show a lack of consent are actual force used by the perpetrator against the victim and threats of immediate bodily harm to the victim.  Furthermore, a victim is incapable of consenting if they are intoxicated or unconscious.  Thus, if the victim was intoxicated during the alleged rape, then she could not have consented to sex.
