A Colorado mother named Kelli Lynn Murphy has been charged with the murders of her two children.  She suffocated her 6-year-old daughter and 9-year-old son to death as revenge against her husband after they filed for divorce.

According to Murphy’s attorney, Murphy “had intended to kill herself and blacked out after drinking vodka and taking pills.  Murphy woke up to find her children dead and doesn't remember what happened.”  He tried using her intoxication as a defense to murder and hoped the jurors would mitigate her murder charges.

First Degree Murder

First-degree murder is the unlawful killing of another with malice.  When a person is convicted of first-degree murder, they usually face harsh penalties, such as a life sentence or the death penalty depending on the jurisdiction.  When one is charged with first or second-degree murder, they may receive a lesser charge by mitigating murder to manslaughter or by showing that they have a defense to murder, such as involuntary intoxication.

Lesser charges were not applied in this case, as Murphy was found guilty of two counts of first-degree murder.
