How many of you can distinguish a brand name purse from a knock off purse?  I certainly cannot.  Many people say imitation is the highest form of flattery.  However, the luxury brand, Coach, doesn’t see it that way.

Hundreds of Internet websites have been selling knockoff Coach purses profiting off the companies well-established brand image.   Coach worked hard to establish their brand image and loyalty and is defending it in a counterfeit lawsuit against several Internet companies.

Coach won a judgment for $257 million in damages.  The judge overseeing this case stated that the websites were in violation of the Uniform Deceptive Trade Practices Act.

This is a huge win for Coach as they have won the largest settlement of its kind.  This case will most likely set a precedent for these types of lawsuits.  Counterfeiters beware!

What Is a Trademark?

A trademark is used to distinguish one product from another.  It can be a logo, name, word, phrase, or symbol. Once you get a legal trademark, and another person infringes on your rights to that trademark, you may sue them in federal court, seek damages, and get an injunction against them to make them stop using your intellectual property.
