WhatI wanted to share a very weird product liability lawsuit with the readers of this blog.  A Tennessee lawyer named Chris Sevier filed a products liability lawsuit against Apple Inc., claiming that Apple, Inc. is strictly liable for his porn addition because they placed a defective product in the marketplace.

Lack of Adequate Warnings about Surging the Internet Dangers

Are you wondering how an Apple product can cause an individual’s porn addiction?  Well, according to ABA Journal, Sevier alleges that Apple, Inc is strictly liable for selling an unreasonably dangerous electronic device that lacks pornography filters and does not “adequately warn consumers about the dangers of surfing the Internet.”

Sevier claims that his Mac Book pro took him to F**kbook.com instead of Facebook.com.  He asserts that the adult porn site, F**kbook, "appealed to his biological sensibilities as a male and led to an unwanted addiction with adverse consequences.”

He further asserts, “But for' the Plaintiff's use of the Apple product, the quality of the Plaintiff's life would have been much better and injury would have been avoided."  He claims that the unwarranted intrusions of pornographic content “systematically poisoned his life."  That has got to be my favorite part of his claim.  What happened to self-control?

Sevier’s Claims Against Apple:

  • Products liability
  • Fraudulent misrepresentation
  • Emotional distress

Damages Claimed By Sevier:

  • Jurisdictional damages of more than $75,000
  • Medical expenses
  • Attorney's fees

Sevier also wants a court order to require Apple "to install porn-blocking software on all Apple devices that could not be removed by anyone under 18 years of age.”

Sevier also blames Apple for the breakup of his marriage.
