Background checks are becoming increasingly common in our ever traceable world. Whether in the course of applying for a new job, in order to meet professional licensing requirements, or in other situations, such as renting a home.
While companies can legally conduct background investigations about you, the information is generally subject to certain limitations.
Criminal histories and records may stay on your record for many years, even if the offense is expunged the history is often retained. All public records are searched, including arrests and convictions.
What Information Can Be Used Against You?
Background information is often used to help a company determine whether or not a person has the character necessary to qualify them for a job or whatever other situation involved. Even so, just because a company may come across a record, it does not mean that they may legally rely upon it when determining whether your are fit for employment.
Thus, under certain states’ laws, only certain criminal history information can legally be asked on an employment application. If an employment application question is illegal, you don’t necessarily have to answer what it asks. And your job candidacy cannot be impaired because of it.
