Since the FDA recalled the DePuy ASR XL Acetabular Hip System in August 2010, the lawsuits have been coming in.  In the latest group of lawsuits, 80 Wisconsin residents have filed a lawsuit in the U.S. District Court for the Northern District of Ohio.

Why Are DePuy Lawsuits Being Filed In Ohio If People Live In Other States?

It seems odd that 80 people from Wisconsin are filing a lawsuit in Ohio, but there’s a good reason for this.  The reason the lawsuit was filed in Ohio, is that is where all the federal cases against DePuy have been consolidated.  When a lawsuit is consolidated in a certain District Court, it is brought before one judge in order to speed up the lawsuit process.  This is good news for many victims of DePuy Hip implants, since most suffer from similar injuries, an attorney doesn’t need to present the same evidence multiple times.  This saves the victim money as well, since they may have lower attorney fees.

Why Did The Depuy ASR XL Acetabular Hip System Get Recalled By The FDA?

The FDA recalled the DePuy hip implants because of the higher than normal failure rate of the implant.  This failure rate contributed to both increased revision surgeries and metallosis.  Metallosis is a type of metal poisoning and occurs in metal-on-metal hip implants when microscopic particles of cobalt and chromium enter the body.
