Recent Massachusetts Drunk Driving Verdicts and Settlements Cases

The client crossed the center line into oncoming traffic on three occasions. The officer observed him to have extremely slow and slurred speech, glassy/bloodshot eyes and a strong odor of alcohol on his breath. According to the officer he was swaying as he stood in front of him. The officer testified he could not say the alphabet, touch his finger to his nose or hold his foot up for more than one second. He refused to perform any more tests: Not Guilty Verdict.

The client struck telephone a pole traveling at approximately 30 m.p.h. The police officer indicated in his report that the client had slurred speech and a strong odor of alcohol on his breath. A treating EMT testified that the client told him that he had a lot to drink prior to the accident. The client was taken by ambulance to the hospital where he had blood alcohol concentration that translated to a breathalyzer reading of .28%: Not Guilty Verdict.

The client was driving erratically and struck another vehicle causing injury to all passengers. Client taken to hospital and had blood drawn which showed blood alcohol three times the legal limit: Not Guilty Verdict.

Client pulled over for speeding, traveling 68 m.p.h in 35 zone. Officer makes observations that client has slurred speech, red watery glassy eyes, strong odor of alcohol and observes client to have beer bottle between his legs. Client fails all field sobriety tests: Not Guilty Jury Verdict.

Client pulled over for traveling over the center line on four occasions and does not pull over for one mile after police sound lights and sirens. Client cannot produce license and registration and has strong odor of alcohol coming from his mouth according to officer. Client ordered out of the vehicle where he states “I should not be driving,” and then fails all field sobriety tests and registers a .16 blood alcohol level: Not Guilty Verdict.
